Mother of blind son sent to jail

A woman who acts as a carer for her registered blind son was jailed for three months today for “a flagrant breach” of a court order sparing her a prison sentence.

Yvonne Mackie originally escaped a jail term after admitting assaulting another woman who was invited to her home.

But Mackie (43) failed to comply with a community payback order imposed on her in January this year under which she was required to carry out 75 hours unpaid work.

A judge told her she had failed to attend appointments on more than one occasion despite warnings she had been given.

Lord Uist said: “It makes a mockery of such orders if endless warnings are given.”

The judge told her at the High Court in Edinburgh that he would revoke the order and order that she start a prison sentence from today.

Mackie had turned up at Claire McAulay’s home with an accomplice and suggested she go to her house in Coalgate Avenue, Tranent, in East Lothian, on July 5 to pick up some money owed by her sister.

But at Mackie’s house the incident turned violent with Ms McAulay being punched repeatedly by the other woman and James Ferguson producing a knife which was put against the victim’s head.

Lord Uist told Mackie when he earlier spared her a prison sentence: “She was a woman whom you had invited to your home and while she was there you assaulted her.”

“I am told you punched her to the face and body 20 to 30 times and caused her nose to bleed. This was quite disgraceful behaviour on your part,” he said.

Defence solicitor advocate John Keenan told the court that Mackie accepted she had breached the community payback order, but wished the chance to be allowed to complete it.

He said Mackie’s 22-year-old son, who lived with her, was registered blind.

Ferguson (29) a prisoner, who earlier admitted a string of assaults in East Lothian, has still to be dealt with for his offences, but could face a life sentence after it was ordered that a full risk assessment be carried out on him.
