Shop apologises for ‘genuine oversight’

Failure to declare three health and safety convictions south of the border when applying for premises licences for outlets in Musselburgh landed Martin McColl Limited in hot water.
The national company, which operates more than 1,300 stores in England, Scotland and Wales, was called to answer at a licensing review hearing in Haddington.
Councillors who sit on East Lothian Licensing Board accepted it had been a “genuine oversight” and agreed to take no action.
Rudi Fruzynski, Licensing Standards Officer, explained that David Crank, on behalf of the company, applied for a provisional premises licence for the shop premises at 160 High Street in Musselburgh in April 2010.
“At this time, as required by law, a number of convictions and cautions were declared, all of which referred to company premises in England and Wales. The full premises licence was confirmed in February 2011,” he reported to the East Lothian Licensing Board meeting.
He added that an application was also received to transfer the premises licence for Raja Food Store in Delta Drive to Martin McColl Limited the same month.
“There were no objections and the application was successful,” stated Mr Fruzynski.
The board heard that in November 2011, Mr Crank discovered that two convictions had been “inadvertently” missed at the time and that a further one, dated August 2010, which came after the applications, had also not been notified to the board as required under the Licensing (Scotland) Act 2005.
